Welcome to Nookaly. These Terms of Service ("Terms") govern your use of the Nookaly browser extension, website, and related services (collectively, the "Service") operated by Nookaly ("we", "us", or "our").

By installing, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

1. Description of Service

Nookaly is an AI-powered Chrome browser extension that provides property insights and analysis when browsing property listings on supported platforms, currently including Rightmove (rightmove.co.uk) and Zoopla (zoopla.co.uk).

Nookaly does not scrape, crawl, or extract data from Rightmove, Zoopla, or any other property portal. The extension reads only the URL of the page you are viewing in order to identify the property listing — no page content, DOM elements, listing text, or images are read or extracted from these websites. Property listing data is obtained separately from third-party data providers. The Service analyses this data alongside publicly available information to provide:

• Personalised match scores based on your stated preferences
• AI-generated property analysis and summaries
• Commute time calculations to your chosen destinations
• Area demographics, safety statistics, and amenity data
• Property comparison tools
• School ratings and nearby amenity information

2. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

3. Account Registration

To access certain features of the Service, you may need to create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security and confidentiality of your login credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorised use of your account

4. Credits and Payments

Certain features of the Service may require credits. Free credits may be provided upon registration. Additional credits may be purchased through the Service.

• Credits are non-transferable and non-refundable unless required by applicable law
• We reserve the right to modify credit pricing and allocation at any time
• Unused credits do not expire unless your account is terminated
• We will provide reasonable notice of any material changes to the credit system

5. Acceptable Use

You agree to use the Service only for its intended purpose of property research and analysis. You must not:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to reverse engineer, decompile, or disassemble the Service
• Use automated tools to scrape, harvest, or extract data from the Service
• Interfere with or disrupt the Service or servers connected to the Service
• Attempt to gain unauthorised access to any part of the Service
• Reproduce, redistribute, or commercially exploit any content from the Service without our prior written consent
• Use the Service to collect personal data about other individuals
• Misrepresent your identity or affiliation when using the Service

6. AI-Generated Content Disclaimer

The Service uses artificial intelligence to analyse property listings and generate insights. You acknowledge and agree that:

• AI-generated analysis, scores, and recommendations are provided for informational purposes only and should not be the sole basis for any property decision
• AI analysis may contain inaccuracies, errors, or incomplete information
• Match scores and property ratings are based on AI interpretation and your stated preferences, and may not accurately reflect the true condition or suitability of a property
• The Service does not replace professional property surveys, valuations, or legal advice
• We strongly recommend conducting independent due diligence, including professional surveys and legal checks, before making any property decisions
• Investment scores and condition ratings are AI estimates based on visible indicators in photographs and should not be treated as professional valuations
• Beyond basic factual attributes (address, price, bedrooms, bathrooms), the property data stored by Nookaly is AI-generated content (scores, summaries, tags, assessments). This content represents automated AI interpretations, not verified facts, and may be inaccurate

7. Third-Party Content and Services

Property listing data displayed within the Service is sourced from third-party data providers — not by scraping or crawling Rightmove, Zoopla, or any other website. The only information the extension reads from these websites is the URL of the page you are viewing, solely to identify the listing. No page content is read or extracted. The Service also uses data from various public sources (such as government open data for EPC ratings, crime statistics, and demographics).

Nookaly does not store any copyrightable content from Rightmove or Zoopla (such as listing descriptions, photographs, or floorplans). We do store basic factual property attributes — such as address, price, number of bedrooms, and number of bathrooms — which are non-copyrightable facts about properties that are publicly marketed for sale or rent. In addition, we store AI-generated analysis, scores, and insights derived from listing data. This AI-generated content represents automated interpretations and opinions — it is not factual data and should not be treated as such (see Section 6).

We do not control third-party platforms or data providers and are not responsible for:

• The accuracy or completeness of property listing data provided by third-party sources
• Changes to third-party platforms that may affect the Service
• The availability of third-party data sources or providers

The Service is not affiliated with, endorsed by, or sponsored by Rightmove or Zoopla.

8. Intellectual Property

The Service, including its design, code, AI models, algorithms, and branding, is owned by Nookaly and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Service for personal, non-commercial property research purposes.

Property listing data, images, and descriptions displayed through the Service remain the intellectual property of their respective owners (estate agents, property portals, etc.).

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data. By using the Service, you consent to the practices described in the Privacy Policy.

10. Service Availability

We strive to provide the Service on a continuous basis but do not guarantee uninterrupted availability. The Service may be temporarily unavailable due to:

• Scheduled or emergency maintenance
• Updates and improvements
• Factors beyond our reasonable control
• Changes to third-party platforms on which the Service depends

11. Limitation of Liability

To the fullest extent permitted by applicable law:

• The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied
• We do not warrant that the Service will be error-free, complete, or uninterrupted
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
• Our total liability for any claims arising from these Terms shall not exceed the total amount you have paid to us in the twelve months preceding the claim
• We are not liable for any financial loss, property decisions, or other consequences arising from reliance on AI-generated content provided by the Service

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may terminate your account at any time by contacting us or using the account deletion feature within the Service. Upon termination:

• Your right to use the Service will immediately cease
• We may delete your account data in accordance with our Privacy Policy
• Any unused credits will be forfeited unless required otherwise by applicable law

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website and, where possible, through the extension. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
